Termination, suspension, or cancellation of this Agreement or your access rights will not affect any right or relief to which Point Blank may be entitled in law or in equity. Upon termination of this Agreement all rights granted to you will automatically terminate. Paragraphs 3, 5, 8, 9, 10, 11 and 13 shall survive termination of this Agreement.
Point Blank Music College, Point Blank Tutorials, Point Blank Music, 'Learn, Participate, Create' trademarks, logos and product and service names are trademarks of Point Blank Music College. Without Point Blank's prior permission, you agree not to display the above or use in any manner.
The T&Cs agreement and any posted operating rules constitute the entire agreement between you and Point Blank and govern your use of the Web site, superceding any prior agreements between you and Point Blank with respect to the subject matter of this Agreement. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. You may not assign your rights under this Agreement to any third party. The T&Cs and the relationship between you and Point Blank shall be governed by the laws of the UK without regard to its conflict of law provisions. You and Point Blank agree to submit to the personal and exclusive jurisdiction of the courts located within the city of London, England. The failure of Point Blank to exercise or enforce any right or provision of the T&Cs shall not constitute a waiver of such right or provision. If any provision of the T&Cs is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the T&Cs remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Online Service or the T&Cs must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the T&Cs are for convenience only and have no legal or contractual effect.
